Filing 73 MEMORANDUM & ORDER granting in part and denying in part 57 , 60 and 69 : For the reasons set forth in the attached Memorandum & Order, Plaintiff's motion to substitute is granted in part and denied in part. Lois Schmitt, as Peter Schmitt 039;s successor, is substituted for Peter Schmitt as a defendant in this action. Defendants' motion for summary judgment is granted in part and denied in part. Defendants' motion for summary judgment is denied as to Plaintiff's First Amendment and New York Labor Law claims. Defendants' motion for summary judgment is granted with respect to Plaintiff's §§ 1983 and 1985 conspiracy claims and all claims brought against Defendant Schmitt in his official capacity.
