Summa v. Hofstra University, 715 F. Supp. 2d 378, 383-84 (E.D.N.Y. 2010) (collecting cases) (internal quotation marks and alterations omitted); see also Harper v. Gov't Employees Ins. Co., 826 F. Supp. 2d 454,456 (E.D.N.Y.) ("A motion to authorize a collective action...is a non-dispositive motion upon with a [m]agistrate [j]udge has authority to rule."). Thus, the decision of whether to "grant[] conditional certification of this action as a collective action for purposes of notice and discovery, and for allowing potential plaintiffs to opt-in to the case concerns a non-dispositive pretrial matter." Summa 715 F. Accordingly, as the Plaintiff's original motion for conditional certification was properly before United States Magistrate Judge Thomas E. Boyle, the Plaintiff's renewed motion for conditional certification is properly before United States Magistrate Judge Arlene R. Lindsay. As such, Judge Lindsay shall decide the motion.
