Filing 44 ORDER granting 22 : For the reasons set forth in the attached Memorandum & Order, defendants' motion to dismiss the Amended Complaint is granted. Plaintiff will, however, be permitted to move for leave to amend his pleading to assert a claim under 29 U.S.C. § 529, as set forth above. Plaintiff's motion to amend must be served on or before September 4, 2012. Defendants' opposition shall be served on or before October 4, 2012. Plaintiffs' reply, if any, shall be served, and all papers shall be filed, on or before October 19, 2012.
