Filing 8 MEMORANDUM AND ORDER granting 2 Motion for Leave to Proceed in forma pauperis. For the reasons set forth herein, the Plaintiff's application to proceed in forma pauperis is GRANTED, but is DISMISSED WITH PREJUDICE as against the Suffolk Count y Correctional Facility and the Suffolk County Sheriff's Office. Plaintiff is granted leave to file an Amended Complaint against a proper defendant in accordance with this Order. Any Amended Complaint must be filed within thirty (30) days of th e date that notice of entry of this Order is served upon the Plaintiff and Plaintiff is warned that his failure to timely file an Amended Complaint will lead to the dismissal of his Complaint and the case will be closed.
