June 19, 2012	Filing 10 MEMORANDUM AND OPINION: For the reasons set forth in the attached Memorandum and Order, IT IS HEREBY ORDERED that the petition for a writ of habeas corpus is dismissed as time-barred. In any event, petitioners claims are procedurally barred and fail on the merits. Because petitioner has failed to make a substantial showing of a denial of a constitutional right, no certificate of appealability shall issue. See 28 U.S.C. § 2253(c)(2). The Clerk of the Court shall enter judgment accordingly and close the case. SO ORDERED. Ordered by Judge Joseph F. Bianco on 6/19/2012. (O'Neil, Jacquelyn)
