ORDER granting 74 Motion for Summary Judgment. For the reasons contained herein, IT IS HEREBY ORDERED that defendants' motion for summary judgment is granted, and the amended complaint is dismissed with prejudice. The Clerk of the Court sha ll enter judgment accordingly and close the case. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Memorandum and Order would not be taken in good faith and, therefore, in forma pauperis status is denied for purpose of an appeal.
