For the foregoing reasons, Plaintiff's application to proceed in forma pauperis is granted and the Court orders service of the Complaint without prepayment of the filing fee. Plaintiff's application for the appointment of pro bono counsel is denied without prejudice at this time. The Clerk of the Court is directed to forward to the United States Marshal for the Eastern District o f New York copies of the Plaintiff's Summons, Complaint and this Order for service upon the Defendant without prepayment of the filing fees. Furthermore, the Clerk is directed to mail a copy of the Order to the Plaintiff. The Court certifies pur suant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
