Filing 103 MEMORANDUM AND ORDER; For the reasons stated herein, the Court finds that Plaintiff has established that Defendants breached the parties' agreement by failing to return its share of the distribution once Abcon was no longer satisfied with the re solution that was achieved with NYCB. Therefore, the Court awards Plaintiff $463,000 on its claim for breach of contract. Further, the Court finds that Defendants have sufficiently stated a claim for quantummeruit, and awards Defendants $568,845 in fees for the services provided to Plaintiff Abcon.
