Filing 16 ORDER granting 3 Motion for Preliminary Injunction. SO ORDERED that Plaintiff's motion for a preliminary injunction is GRANTED. Defts and the Suffolk County Police Department are hereby ENJOINED from:( 1) enforcing, or threatening or attempti ng to enforce, the now-repealed N.Y. PENAL LAW § 240.35(1) and( 2) arresting, threatening or attempting to arrest, anyone for loitering, remaining, or wandering about for the purpose of begging. Plaintiff is warned, however, that Defts are not enjoined from arresting individuals for violating other, valid sections of the Penal Law while panhandling. The court certifies pursuant to 28 U.S.C. § 1915(a) (3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
