ORDER granting 17 Motion for Summary Judgment; granting 19 Motion to Dismiss for Failure to State a Claim; granting 19 Motion to Dismiss for Lack of Jurisdiction: For the reasons set forth herein, the Court grants the Town Defendants' motion for summary judgment and dismisses the claims against them with prejudice. The claims for injunctive and declaratory relief against Sarowitz are dismissed without prejudice. The Clerk of the Court shall enter judgment accordingly and close the case. SO ORDERED.
