Filing 47 MEMORANDUM OF DECISION AND ORDER - For the foregoing reasons, it is hereby: ORDERED, that the Defendants motion to dismiss the Plaintiffs Section 1983 causes of action on the ground of claim splitting is granted and these claims are dismissed witho ut prejudice; and it is further ORDERED, that the Plaintiffs causes of action for declaratory judgment are dismissed without prejudice on the ground of Brillhart abstention; and it is further ORDERED, that the Plaintiffs motion to amend is denied as moot; and it is further ORDERED, that the Plaintiffs action is dismissed in its entirety; and it is further ORDERED, that the Clerk of the Court is directed to mark this case as closed.
