For the reasons set forth herein, the Court denies defendants' motion to dismiss with respect to plaintiffs' EPA, NY EPA, and Section 1307 clai ms. The Court grants defendants' motion to dismiss with respect to plaintiffs' Section 1983 claim against Mangano, but denies the motion with respect to the Section 1983 claim against the County defendants.
