ORDER granting in part and denying in part 34 Motion for Judgment on the Pleadings. SO ORDERED that counts I, II, III and V of the complaint are dismissed. Plaintiff is granted leave to file an amended complaint with respect to the fraud and torti ous interference claims within thirty (30) days of the date of entry of this Order.
