Defendants' motion to dismiss is GRANTED IN PART and DENIED IN PART. The Clerk of the Court is directed to docket the proposed Second Amende d Complaint as the operative Second Amended Complaint. However, the only remaining claims are Plaintiff's Section 1983 claims for First Amendment retaliation and First Amendment intimate association as well as Plaintiff's claim for injunctive relief under the Public Officer's Law.
