Filing 42 ORDER granting 24 Motion for Summary Judgment; granting 25 Motion for Summary Judgment: For the reasons set forth herein, the Court grants the County Defendants' motion for summary judgment and grants Peconic Bay's motion for summary judgment on the ground that plaintiff has failed to exhaust his administrative remedies. Accordingly, the complaint is dismissed without prejudice. The Clerk of the Court shall enter judgment accordingly and close the case. SO ORDERED. Ordered by Judge Joseph F. Bianco on 9/3/2013.
