MEMORANDUM & ORDER re: 25 Motion is GRANTED and Plaintiff's Complaint is DISMISSED WITHOUT PREJUDICE with leave to file an amended complaint within thirty (30) days of the date of the M&O. If an amended complaint is not received within this ti me, the trade dress claim will be dismissed with prejudice and this action will be closed. It is further ORDERED, that the Court declines to extend supplemental jurisdiction over Laraia's state law counterclaim, and such claim is DISMISSED WITHO UT PREJUDICE. All discovery is STAYED pending either the filing of an answer or this Court's resolution on the motion to dismiss. Re: 48 Laraia's appeal of Judge Tomlinson's discovery order is DENIED with leave to refile within 14 days of the discovery stay being lifted. Plaintiff's counsel is ORDERED to provide the Court with updated contact information. Ordered by Judge Joanna Seybert on 7/24/2013. (Nohs, Bonnie)
