P. 12(b)(6) is granted in part and denied in part. The Court dismisses the Plaintiffs Substantive due proces s claim and claim for declaratory judgment and permanent injunctive relief, but declines to dismiss the Plaintiffs procedural due process claim. The Court finds that the Plaintiff has stated a viable 42 U.S.C. § 1983 claim that the Defendant violated his procedural due process rights under the Fourteenth Amendment of the United States Constitution and for municipal liability under Monell. So Ordered by Judge Arthur D. Spatt on 2/6/2014. (Coleman, Laurie)
