ORDER denying 63 Motion for Summary Judgment; granting 65 Motion for Summary Judgment: IT IS HEREBY ORDERED that Grid's Summary Judgment Motion is GRANTED. Ace is directed to defend and indemnify Grid in the underlying Llaguno Action. In accordance with the Court's prior decision on the Defendants' Motion to Dismiss, Grid may pursue claims against Brand based on Article 11 of the Agreement after a determination as to Grid's liability in the Llaguno Action. IT IS FURT HER ORDERED that the Defendants' Summary Judgment Motion is DENIED. The Clerk of Court is directed to enter judgment in favor of the Grid. (See attached Memorandum and Order.)
