July 10, 2013 Opinion or Order Filing 22 ORDER granting in part and deferring ruling on in part 10 Motion to Dismiss, Vacate Stay and Compel Arbitration. For the reasons set forth in the attached Memorandum and Order, the Court grants respondent's motion to vacate the stay and to co mpel arbitration. The Court will not make any determination on the pending motion to dismiss until the case has proceeded through arbitration. Accordingly, the parties are ordered to proceed to the Collective Bargaining Agreement's arbitration process. This action is stayed pending the outcome of the arbitration. SO ORDERED.
