MEMORANDUM AND ORDER denying in part and dismissing in part 95 Motion for Summary Judgment. For the reasons discussed herein, Defendants' motion for summary judgment is denied, except as to Plaintiffs' claims for negligence and malpractice, which are hereby dismissed.
