ORDER granting 17 Motion to Dismiss for Failure to State a Claim. For the reasons set forth herein, the Court grants Alterra's motion to dismiss in its entirety, and the claim against Alterra is dismissed without prejudice. In addition, the Court denies plaintiffs' cross-motion to file the amended complaint because the proposed amendment would be futile given the lack of standing to bring a claim for declaratory relief at this juncture.
