ORDER granting in part and denying in part #32 Motion to Dismiss for Failure to State a Claim; granting in part and denying in part #35 Motion to Dismiss for Failure to State a Claim; granting in part and denying in part #45 Motion to Amend/Correct/Supplement; terminating #56 Motion for Extension of Time to File Response/Reply. For the reasons set forth herein, the Court grants defendants summary judgment motion on all claims brought by Kenneth, as well as on the claims brought by Kenneth on behalf of Andrew for false imprisonment, abduction, and alienation of affections. The claims brought by Andrew for conspiracy, piercing the corporate veil, and punitive damages are dismissed only to the extent that they are alleged as separate causes of action (although the allegations supporting each of those theories of liability and damages can remain). Moreover, any motion to amend these claims is denied as futile. However, defendants motion is denied as to the claims brought by Andrew for intentional infliction of emotional distress and assault, and Andrews motion to amend is granted to the extent that he wishes to re-plead those claims with himself as the plaintiff. In its discretion, the Court has not applied the summary judgment standard to those claims, and defendants may move for summary judgment with respect to the Second Amended Complaint once discovery is complete.
