ORDER granting 26 Motion for Summary Judgment; denying 27 Motion for Partial Summary Judgment; denying 30 Motion for Partial Summary Judgment. For the reasons set forth herein, the Court grants AmGuards motion for summary judgment on its cla im for declaration of non-coverage, and denies defendants cross-motion for summary judgment. AmGuard has no duty to defend or indemnify in connection with the Underlying Action commenced by Scordo. The Clerk of the Court shall enter judgment accordingly and close this case. SO ORDERED.
