Filing 112 DECISION AND ORDER granting in part and denying in part 100 Motion to Amend the Complaint - In sum, the Plaintiffs motion to file a third amended complaint is granted in part and denied in part. The motion is granted to the extent the Plaintiff s eeks to assert a claim that Sookhu and Brunswick are liable to him for any charges that the Plaintiff must pay to satisfy any Medicaid lien. The motion to add Hunter EMS as a party defendant is denied. The motion is otherwise denied. The Plaintiff is directed to file a third amended complaint consistent with this Order within 14 days of the date of this Order. Sookhu and Brunswick will then have 30 days to formally move to dismiss the Medicaid lien claim. The Court reserves decision on the motion to dismiss. So Ordered by Judge Arthur D.
