Pur suant to 28 U.S.C. § 1406, the Court grants the Defendants motion to the extent the Court finds that venue in the Eastern District of New York is improper. The Clerk of the Court is directed to transfer this case to the Northern District of New York. The remaining branches of the Defendants motion are denied without prejudice with leave to renew in accordance with the individual rules of the newly-assigned district court judge.
