MEMORANDUM OF DECISION & ORDER: On March 20, 2014, the Plaintiff filed an action alleging, inter alia, breach of contract against the Defendant, a Write-Your-Own ("WYO") Program carrier participating in the U.S. Government's National F lood Insurance Program ("NFIP") pursuant to the National Flood Insurance Act of 1968, as amended ("NFIA"). In the Complaint, the Plaintiff demanded a jury trial. Presently before the Court is a motion by the Defendant to quash the Plaintiffs jury demand, pursuant to Federal Rule of Civil Procedure (Rule) 39(a)(2). MEMORANDUM OF DECISION & ORDER granting 49 Motion to Dismiss; For the foregoing reasons, it is hereby ordered that the Fairmonts motion is granted in its entirety and the Plaintiffs claims as to Fairmont are dismissed. Accordingly, the Plaintiffs sole remaining cause of action is a breach of contract claim against Foremost.
