ORDER ADOPTING REPORT AND RECOMMENDATIONS: For the reasons set forth above, plaintiffs objections are overruled, the Report 161 is accepted in its entirety and, for the reasons set forth therein, Verizons motion pursuant to Rule 56(d) of the Federa l Rules of Civil Procedure, requesting that the Court defer consideration of plaintiffs pending motion for summary judgement 158 until after the completion of discovery relevant to the issues raised by plaintiffs motion 160 , is granted; and plaintiffs motion for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure is denied without prejudice to renewal upon the completion of such discovery.
