September 9, 2015 Opinion or Order Filing 23 ORDER: SO ORDERED that the amended complaint shall be served on the sole deft, Stilletto, by the United States Marshal forthwith. The Clerk of the Court shall, pursuant to Rule 77(d)(l) of the Federal Rules of Civil Procedure, serve notice of entry of this Order upon plaintiff in accordance with Rule 5(b) of the Federal Rules of Civil Procedure. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith and, therefore, denies in forma pauperis status for the purpose of any appeal. December 8, 2014 Opinion or Order Filing 9 OPINION & ORDER granting 3 Motion for Leave to Proceed in forma pauperis. SO ORDERED that plaintiff's application to proceed in forma pauperis is granted and the complaint is sua sponte dismissed with prejudice as against the Suffolk County C orrectional Facility pursuant to 28 U.S.C. §§ 1915(e)(2)(B)(ii) and 1915A(b). Plaintiff's claim against C.O Stilletto is dismissed with prejudice pursuant to 28 U.S.C. §§ 1915(e)(2)(B)(ii) and 1915A(b) unless plaintiff files an amended complaint as set forth above on or before January 15, 2015. If plaintiff does not file an amended complaint within the allotted time, the original complaint shall be served upon deft Maldonado immediately thereafter by the United States Ma rshal. If plaintiff does file an amended complaint, the Court will review it pursuant to 28 U.S.C. § 1915A. The Clerk of the Court shall, pursuant to Rule 77(d)(1) of the Federal Rules of Civil Procedure, serve notice of entry of this Order upon plaintiff in accordance with Rule S(b) of the Federal Rules of Civil Procedure. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
