Filing 24 ORDER granting 11 Motion to Dismiss for Failure to State a Claim For the reasons discussed herein, the Court grants defendants motion to dismiss and dismisses the Section 1983 claim with prejudice. The Clerk of the Court shall enter judgment acco rdingly and close the case. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Memorandum and Order would not be taken in good faith and, therefore, in forma pauperis status is denied for purpose of an appeal.
