Filing 6 OPINION & ORDER granting in part and denying in part 5 Motion to Dismiss for Failure to State a Claim. SO ORDERED that the branches of defts motion seeking dismissal of plaintiffs claims against the NYDOCCS defts pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure are granted; plaintiffs claims against the NYDOCCS defts are dismissed in their entirety with prejudice for failure to state a claim for relief; and defts motion is otherwise denied. There being no just reason for delay, the Clerk of the Court shall enter judgment in favor of the NYDOCCS defts pursuant to Rule 54(b) of the Federal Rules of Civil Procedure.
