For the reasons set forth in the attached Memorandum and Opinion, Plaintiff's motion for attorney's fees and costs is granted. Plaintiff shall be awarded $817,131.33 in attorney's fees and $33,353.48 in costs, for a total monetary award of $850,484.81. So Ordered by Magistrate Judge Anne Y. Shields on 2/19/2024. (DM)
December 16, 2021 Opinion or Order Filing 116 MEMORANDUM & ORDER: IT IS ORDERED that Defendants' 111 motion for summary judgment is DENIED. It is FURTHER ORDERED that: 1) Within thirty days from the date of this Memorandum & Order, Plaintiff shall file an amended complaint that omits the five causes of action that he agreed to withdraw; 2) All claims against the County are DISMISSED, and the Clerk of the Court shall terminate the County as a party to this action; 3) All claims against County Police Sergeant Anthony Gabrielli and the John Doe Defendants are DISMISSED, and the Clerk of the Court shall terminate them as parties to this action. July 31, 2015 Opinion or Order Filing 22 MEMORANDUM & ORDER granting 12 Motion to Dismiss for Failure to State a Claim; For the foregoing reasons, Defendants' partial motion to dismiss (Docket Entry 12) is GRANTED and Plaintiff's claims for false arrest, assault, battery, defa mation, and failure to supervise are DISMISSED WITH PREJUDICE. Plaintiff's claims for malicious prosecution, the denial of medical treatment, excessive force, due process, failure to intervene, attorney fees, and Monell liability survive and shall proceed.
