ORDER granting 17 Motion to Dismiss for Failure to State a Claim. For the reasons set forth in the attached Memorandum and Order, Defendants' motion to dismiss is granted. Accordingly, Plaintiffs' claims are dismissed without prejudice . The Court notes that Plaintiffs have already filed an Amended Complaint as a matter of right in this action. However, to the extent Plaintiffs wish to file a second amended complaint they must do so within thirty (30) days of this Order. Ordered by Judge Denis R. Hurley on 7/14/2015. (Kaley, Regina)
