MEMORANDUM & ORDER ADOPTING REPORT AND RECOMMENDATION - The Court finds Judge Locke's Report and Recommendation to be thorough and well-reasoned. For the foregoing reasons, Defendant's objections are OVERRULED, and the R&R is ADOPTED in it s entirety. Plaintiffs' motion for summary judgment (Docket Entry 54) is GRANTED IN PART and DENIED IN PART, and Defendant's motion for summary judgment (Docket Entry 53) is DENIED. Defendant's motion to dismiss Barbato's claims i s also DENIED, and Defendant's motion to decertify the conditional class is GRANTED. The parties shall file letters within fourteen (14) days of the date of this Memorandum and Order setting forth their respective positions on scheduling a settlement conference with Judge Locke.
