MEMORANDUM OF DECISION & ORDER granting in part and denying in part 38 Motion for Summary Judgment. Based on the foregoing, the Defendants motion for summary judgment is granted in part and denied in part. In particular, the Court grants summary j udgment dismissing: (1) the Plaintiffs claim against Brown, in his individual capacity, for disability discrimination under the ADA; (2) the Plaintiffs claim based on an ADA hostile work environment; and (3) the Plaintiffs claim based on disability d iscrimination under § 1983. However, the Court denies summary judgment as to the Plaintiffs claim against the District and Brown, in his official capacity, based on disability discrimination under the ADA. This matter is hereby recommitted to United States Magistrate Judge A. Kathleen Tomlinson for the completion of discovery. SEE ATTACHED DECISION for details. It is So Ordered by Judge Arthur D.
