July 10, 2017 Opinion or Order Filing 42 MEMORANDUM OF DECISION AND ORDER - For the reasons stated above, CUNYs 33 motion for a judgment on the pleadings pursuant to Rule 12(c), dismissing the Plaintiffs complaint, is granted in part, and denied in part. It is granted to the extent that t he Plaintiffs hostile work environment claim is dismissed; the Plaintiff may not rely on any events before 2008 in her Title VII discrimination claim; and the Plaintiff may only proceed on her Title VII retaliation claim based on CUNYs alleged acts after she filed an internal complaint in December 2014. It is denied to the extent that the Plaintiffs Title VII discrimination and retaliation claims nevertheless survive 12(b)(6) scrutiny. The case is respectfully referred to Magistrate Judge Arlene R. July 15, 2016 Opinion or Order Filing 29 MEMORANDUM OF DECISION AND ORDER granting 12 Motion to Dismiss for Lack of Jurisdiction; denying 19 Motion to Amend/Correct/Supplement; For the foregoing reasons, the City Defendants partial motion to dismiss is granted as unopposed; Queens Colle ge is hereby dismissed from this action; the Plaintiffs ADEA and Section 1983 claims are dismissed in their entirety; and the Plaintiffs cross motion for leave to file a second amended complaint is denied. For the purpose of clarity, the Court notes that the only remaining viable claims in this action are the Plaintiffs Title VII claims against CUNY for gender discrimination, hostile work environment, and retaliation.
