OPINION and ORDER granting in part and denying in part 19 Motion for Summary Judgment; For the reasons set forth above, the branch of defendants motion seeking summary judgment dismissing plaintiffs FDCPA claims pursuant to Rule 56 of the Federal Rules of Civil Procedure is granted; defendants are awarded judgment dismissing plaintiffs FDCPA claims against them in their entirety with prejudice; plaintiffs state law claims are dismissed without prejudice pursuant to 28 U.S.C. § 1367(c)(3 ); defendants motion is otherwise denied; and plaintiffs cross motion is denied in its entirety.
