February 2, 2021 Opinion or Order Filing 102 ORDER granting 99 Defendants' Motion for Summary Judgment. For the reasons explained in the accompanying Memorandum and Order, the defendants' motions for summary judgment are GRANTED, and Mr. Walker's claims are dismissed in their e ntirety. The Clerk of Court is directed to enter judgment in favor of the defendants, to serve a copy of the Memorandum and Order and the judgment on Mr. Walker at his address of record, to note the service by mailing on the docket, and to close this case. The court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith, and therefore in forma pauperis status is denied for purposes of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). Ordered by Judge Kiyo A. Matsumoto on 2/2/2021. (Mayer, Michael)
September 22, 2016 Opinion or Order Filing 32 ORDER ADOPTING REPORT AND RECOMMENDATIONS: IT IS HEREBY ORDERED that the Court adopts the R&R in its entirety. The County Defendants' motion to dismiss is denied. The Armor Defendants' motion to dismiss is granted with respect to plaintiff s claims that defendants Margos and Sanchez violated his Eighth andFourteenth Amendment rights by failing to provide a cane for approximately eleven months and refusing to refer plaintiff to community-based specialists, but denied in all other respec ts. Plaintiff is granted leave to replead his allegations that were dismissed in an amended complaint, and in fact, plaintiff has already done so on August 24,2016. Defendants shall respond to the Amended Complaint by October 24, 2016, and Magistrate Judge Locke will initiate thediscovery process.. Ordered by Judge Joseph F. Bianco on 9/22/2016.
