March 26, 2020 Opinion or Order SCHEDULING ORDER: It appears from a review of the docket that Plaintiff still has a pending ADA claim against Defendant Narco. Plaintiff is directed to submit a letter to this Court on or before April 27, 2020, advising whether he has, in fact, filed for Chapter 7 bankruptcy, as Defendant has stated. In addition, counsel for Defendant Narco is directed to submit, on notice to Plaintiff by April 27, 2020, a copy of any stipulation of settlement reached during its client's bankruptcy proceeding upon which it takes the position that the remaining ADA claim is settled. Defendant Narco shall also provide the Court with support for its position that a Chapter 7 bankruptcy plaintiff's previously filed ADA suit is subject to the automatic stay, or that such a plaintiff may not pursue an action, for any other reason, as a result of a Chapter 7 filing. Defendant Narco's counsel is directed to serve a copy of this Order on Plaintiff, as well as Plaintiff's Chapter 7 bankruptcy trustee, if any, and to file proof of service on the docket sheet by March 30, 2020. May 12, 2016 Opinion or Order Filing 47 ORDER: On November 17, 2015, plaintiff filed a pro se in forma pauperis complaint also against Narco Freedom in the United States District Court for the Southern District of New York. (Brand II). By Transfer Order dated March 22, 2016, Brand II was transferred to the Eastern District of New York and, on March 30, 2016, it was assigned docket number 16-CV-1575 (JMA) (GRB). The application to proceed in forma pauperis in Brand II is granted. However, the complaint in Brand II alleges similar claims based on the same set of facts alleged in Brand I. Because the complaint in Brand II is repetitive of the claims alleged in Brand I, the Court consolidates them under the first filed complaint, 15-5021 (JMA)(GRB), and directs that the case assigned docket number 16-1575 (JMA)(GRB) be closed. All future filings shall be made only under docket number 15-5021 (JMA)(GRB). Given the stay entered in Brand I of plaintiffs claims against Narco Freedom pending the conclusion of the bankruptcy proceedings in the United States Bankruptcy Court for the Southern District of New York, In re Narco Freedom, Inc., No. 16-10123 (SMB), plaintiffs claims against Narco Freedom in Brand II are likewise stayed. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
