Inc., Pride Solvents & Chemical Co. of N.Y., Inc., Arthur Dhom, Jr, Arthur Dhom, Sr, Cheryl Dhom against Covend LLC, Kean Babylon, Inc., Kew Realty, Pillbox LLC: NOW, THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED THAT: 1. The purpose of this Decree is to resolve claims set forth in the Complaint, the Amended Complaint and any other claims which could have been made by the State against the Settling Thi rd-Party Defendants with regard to the Matters Addressed, defined in Paragraph 2 below; to release the Settling Third-Party Defendants from liability for the Matters Addressed; and to provide full and complete contribution protection to the Settling Third-Party Defendants with regard to the Matters Addressed pursuant to CERCLA § l13(f)(2), 42 U.S.C. § 9613(f)(2). August 13, 2021 Opinion or Order Filing 236 ORDER ADOPTING REPORT AND RECOMMENDATIONS for 230 Sua Sponte - Report and Recommendations: The Court ADOPTS the R&R's reasoning and result insofar that it recommends striking Third Party Defendant Edison Realty, LLC's answer and, accord ingly, hereby STRIKES the 114 Answer to the Third Party Complaint. The Court will not enter a default judgment at this time because the Defendants/Third-Party Plaintiffs' damages on its claims against Edison are contingent on the outcome of the main action against Defendants/Third-Party Plaintiffs.
