REVISED ORDER ADOPTING REPORT AND RECOMMENDATIONS: SO ORDERED that the Court has reviewed the record and, finding no clear error, adopts the R & R as the opinion of the Court. Accordingly, the Court grants defendants' motion to dismiss.
