Filing 50 ORDER granting in part and denying in part 25 Motion to Dismiss for Failure to State a Claim; granting 28 Motion to Amend/Correct/Supplement. For the reasons set forth herein, the Court grants in part and denies in part defendants' motion to dismiss. With plaintiffs' consent, the Court dismisses defendant TPVA and plaintiffs' Article 78 claim (Count 20 of the SAC). In addition, the Court dismisses plaintiffs' bill of attainder, procedural due process, substantive due process, unjust takings, equal protection, and double jeopardy claims under Section 1983 for failure to state a claim with leave to amend. The Court denies defendants' motion with respect to the excessive fines claim. Any amended complaint must be filed within thirty (30) days of this Memorandum and Order. SO ORDERED.
