MEMORANDUM OF DECISION AND ORDER - For the reasons stated above, the Defendants 14 motion to dismiss the Plaintiffs complaint pursuant to Rule 12(b)(6) is granted in part, and denied in part. It is granted to the extent that the following claims are dismissed: all claims against Hangan and Perry; and the retaliation claims pursuant to Section 1981 and the NYSHRL against the individual Defendants. It is denied to the extent that the following causes of action plausibly state a claim upon whic h relief can be granted: the discrimination, retaliation, and hostile work environment claims pursuant to Section 1981, Title VII, and the NYSHRL against Winthrop; the NYLL retaliation claims against Winthrop; and the discrimination and hostile work environment claims pursuant to Section 1981 and the NYSHRL against Occhipinti, Gorenstein, and Bieniek.This case is respectfully referred to Magistrate Judge Arlene R. Lindsay for the remainder of discovery. The Clerk of the Court is directed to term inate Hangan and Perry as defendants in this action, and to amend the official caption as further set forth herein. Donna Hangan (in her individual and official capacity) and Herbert Perry (in his individual and official capacity) terminated. SEE ATTACHED DECISION. So Ordered by Judge Arthur D. Spatt on 6/12/2017.
