Filing 68 MEMORANDUM AND ORDER: For the reasons stated in the attached memorandum and order, Defendants' 63 motion to dismiss for failure to state a claim is GRANTED, and the complaint is dismissed in its entirety. In light of his pro se status, Plaint iff is granted leave to file an amended complaint within 30 days from the entry of this memorandum and order. See Cruz v. Gomez, 202 F.3d 593 (2d Cir. 2000). The amended complaint must be captioned Amended Complaint and bear the same docket number as this memorandum and order. Failure to file an amended complaint within 30 days, as directed by this memorandum and order, will result in dismissal of Plaintiffs case for failure to prosecute.
