September 12, 2019 Opinion or Order Filing 81 ORDER granting in part and denying in part 71 Motion for Summary Judgment. For the reasons set forth in the attached memorandum and order (1) defendants' motion to exclude testimony by plaintiff's treating physicians is DENIED; (2) defen dants' motion for summary judgment as to the negligence per se claims is GRANTED; (3) defendant Future Care's motion for summary judgment is GRANTED; (4) defendants' motion for summary judgment as to plaintiffs claim for maintenance an d cure is GRANTED as to all amounts paid by third parties, but is otherwise DENIED; and (5) defendant Liberty's motion for summary judgment regarding punitive damages and legal fees is DENIED pending trial of this action.The parties are directed to meet and confer and file a joint status report within 10 days of the date of this order regarding a pre-trial order and dates for trial.
