MEMORANDUM OF DECISION & ORDER: For the foregoing reasons, the Court grants the motions to dismiss by Golden Insurance 103 and the Elite Defendants 104 in their entirety. The Court hereby dismisses the main action with prejudice and the third-pa rty action without prejudice. Sutton is directed to inform the Court as to whether it intends to proceed with its fourth-party action against O'Doherty & Cataldo and Dennis O'Doherty, Jr no later than April 30, 2019.
