Filing 35 ORDER: For the reasons stated in the attached, Defendants' 32 motion to dismiss is granted in part and denied in part. Plaintiff's claims against the University and New York State for retaliation in violation of the Rehabilitation Act, a s well as her claim for prospective injunctive relief against Defendant Gergen in his official capacity for retaliation in violation of the ADA shall proceed to discovery. Likewise, Plaintiff's claim against Defendant Gergen in his individual c apacity for retaliation in violation of the FMLA shall proceed. All other claims are dismissed.
