ORDER granting 40 Motion for Reconsideration. As nonparty Merchants Mutual Insurance Company ("Merchants") has represented that it is unable to resolve the dispute with Defendant Thomas William Construction of New York LLC surrounding a subpoena, the Court grants the instant Motion for Reconsideration of Merchants' motion to quash 32 . Upon reconsideration, the Court vacates its previous ruling finding Merchants' motion to quash 32 as moot, and reinstates such motion.
