As nonparty Merchants Mutual Insurance Company ("Merchants") has represented that it is unable to resolve the dispute with Defendant Thomas William Construction of New York LLC surrounding a subpoena, the Court grants the instant Motion for Reconsideration of Merchants' motion to quash 32 . Upon reconsideration, the Court vacates its previous ruling finding Merchants' motion to quash 32 as moot, and reinstates such motion.
