Filing 95 MEMORANDUM AND ORDER granting in part and denying in part DE 79 Motion for Summary Judgment by the Village Defendants, and granting in part and denying in part DE 80 Motion for Summary Judgment by the County Defendants. For the reasons set forth in the attached Memorandum and Order, as to the Village Defendants' Motion, DE 79 , the Court: (i) grants summary judgment as to Plaintiff's abuse of process claim, all claims against the OBPD, all claims against Lamb in his official and individual capacities, all claims against Marino in his official capacity, and the Monell claim against the Village; but (ii) denies summary judgment as to Plaintiff's federal and state malicious prosecution claims against Marino in his i ndividual capacity and on the issue of qualified immunity. As to the County Defendants' Motion, DE 80 , the Court: (i) grants summary judgment as to Plaintiff's abuse of process claim, all claims against the NCPD, all claims against Reav y in his official capacity, and the Monell claim against the County; but (ii) denies summary judgment as to the federal and state malicious prosecution claims against Reavy in his individual capacity and on the issue of qualified immunity.
