October 11, 2017	Filing 12 MEMORANDUM OF DECISION & ORDER - For the foregoing reasons, the Defendant's 9 motion pursuant to Rule 12(b)(6), to dismiss the Plaintiff's complaint is granted without prejudice. The Court also grants the Plaintiffs request for leave to amend the complaint. The Plaintiff is instructed to file an amended complaint that cures the deficiencies discussed above within thirty (30) days of the date of this Memorandum of Decision & Order. Failure to file an amended complaint within thirty ( 30) days shall waive the right to amend granted herein and the claims dismissed without prejudice shall, upon proper motion by the Defendant, be dismissed with prejudice.
