The DOE, the United States, the United States' federal agencies, departments, or instrumentalities shall not lose or waive any such claims by virtue of not taking steps to assert them at the time that the DOE responds to the Second Amended Complaint in this action. 2. Plaintiffs shall not assert in this or any subsequent action or administrative proceeding that any enforcement claims or natural resource damages claims brought by the DOE, the United States, the United States' federal agencies, departments, or instrumentalities relating to the Site and/or conditions at the Site (such as, but not limited to claims to recover CERCLA response costs or natural resource damages), are precluded because such claims were not raised in this action pursuant to FRCP 13(a)(1)(A) or any similar rule, regulation or principle of law, and shall make no defense or avoidance based on such argument.
